مبانی حقوقی پاسداری از توانمندی موشکی بالستیک جمهوری اسلامی ایران در نظام بین‌الملل

چکیده

تاریخ، همواره با ظهور فناوری‌های بدیعی که تطورات معنتابهی را در دنیا رقم زده‌اند، کامل شده است. موشک بالستیک دریچه‌ای از قرایح نظامی و سیاسی کشور‌ها را به روی آنان می‌گشاید و بر دامنه قدرت و اقتدار بین‌المللی آنان می‌افزاید. وجه ممیزات موشک‌های بالستیک از بُعد تسلیحاتی نظیر برد، دقت و سرعت شگرف در حمل کلاهک‌های سنگین و همچنین کاربرد غیرتسلیحاتی آن در صنعت فضایی و پرتاب ماهواره، رجحان آن‌را نسبت به سایر پرتابه‌های مشابه رقم زده است. حساسیت دولت‌های متنفذ بین‌المللی بر سر مسأله موشکی، معلول مختصه ممتاز این فناوری در افزایش توان دفاعی و فضایی کشورها است. به همین سبب در میان فقدان هنجارهای لازم‌الاجرای بین‌المللی، مبادرت به تصمیم‌گیری‌های خودسرانه سیاسی و انحصاری کرده‌اند. آنچه در این تحقیق ازنظر گذرانده می‌شود، بایسته‌های حقوقی دفاع و صیانت از موضوع موشکی جمهوری اسلامی ایران در جولانگاه جهانی است. یافته‌های تحقیق مبین آن است که برخلاف ادعا‌های طرح‌شده، فعالیت‌های مشروع و صلح‌آمیز موشکی کشور در سال‌های بعد از انقلاب اسلامی، نمایانگر احراز حق ذاتی ایران در نظام بین‌الملل است که اعزاز آن و به‌رسمیت‌شناختن حق دفاع موشکی، از تعهدات جامعه‌ بین‌المللی در قبال جمهوری اسلامی ایران محسوب می‌شود.

چکیده [English]

History has always been complete with the advent of new technologies that have brought about so much change in the world. The ballistic missile opens a window on countries' military and political talents and adds to their scope of international power, and authority. The weapons characteristics of ballistic missiles such as range, accuracy and speed in carrying heavy warheads, as well as its non-weapons use in the space industry and satellite launch, have made it superior to other similar rocket. The sensitivity of the international powers over the missile issue is due to the features of this technology in increasing the defense and space capabilities of countries. For this reason, in the absence of the international enforcement rule, they have resorted to arbitrary political and monopolistic decisions. What is considered in this study is the legal requirements for the defense and protection of the missile issue of the Islamic Republic of Iran in the global arena. The findings of the study indicated that the legitimate and peaceful missile activities of the country over the years show the realization of Iran's inherent right in the international system that respects and recognizes the right to missile defense is one of the obligations of the international community against the Islamic Republic of Iran.
