Investigating the Components of Economic Influence in Foreign Investment Contracts with Emphasis on "Iranian Oil Contract Model"

Abstract

This paper attempts to analyze the concept and dimensions of economic influence, Darcy contracts, Reuters, Goss-Golshayian, Amini-Pich and San Maurice contract 1352 as examples of influence on pre-revolutionary foreign investment contracts and a model of component Extraction of intrusions. Accordingly, it was found that the long-term deployment of the foreign party, the colonial and unfair share of the interests, the vesting of the right to exploit the field, the assignment of the right to manage and decide on the field, the existence of intrusive elements in favor of the other party to the contract, and ultimately the non-transfer of technology. Inside is one of the components of economic influence that existed in the Reuter Agreement and the five pre-revolution oil contracts. To this end, a certain limit was put in place to prevent economic influence in the constitution and upstream laws after the revolution. Following on, the characteristics of the "Iran Oil Contract" (IPC) model are examined, and according to the components of influence, it was found that unlike post-revolutionary contracts, at least four key components of influence include long-term foreign settlement, transfer of ownership, transfer of rights. The operation and modification of the share of the proceeds to the benefit of the outside party are contained in the contract and the legal requirements in this regard have been ignored. According to this model, Iran's oil contract with its current coordinates is subject to economic influence in the country's oil and gas sector.
